When love is in the air – don’t give it grounds for divorce!

One of the nicest things about being an Attorney is assisting newlyweds with setting up the right marriage contract and getting their marriage off on the right foot. One of the toughest things about being an Attorney is assisting in divorce matters and watching marriages turn sour.

Fortunately, those couples who took the time and the advice of their Attorneys to set up a good marriage contract are not usually the ones that end up in a divorce court, so when love is in the air, don’t give it grounds for divorce!

Yes, we’ve seen it so many times, In this month of romance, he (or she) may pop the question and before you know it you’ll be walking down the aisle, with expectations of a great life together. Before you do you need to ensure that your marriage contract is the right one for your specific circumstances though and we can give good advice on that. There are different contracts for different circumstances so it’s worth looking into properly.

Don’t let it happen to you

If you don’t have time, or would like just a quick recap, suffice to say if you don’t arrange to sign a marriage contract you automatically fall under a community of property legal status as a married couple? This has some massive disadvantages including no protection for the spouse if one party falls into bankruptcy!

Rather talk to us about an Ante-Nuptial contract before you tie the knot, so you don’t end up tied in a knot you would rather have avoided! Remember that the Ante-Nuptial marriage contract (ANC) is available with and without accrual, so you have the choice of being entirely separated as financial entities in marriage, or to have the benefit of sharing the assets that are accrued within the period of the marriage. The most popular and generally deemed to be the fairest marriage contract is the ANC with Accrual.
